تتابع المنظمات الموقعة علي هذا البيان ببالغ القلق إعلان الرئيس المصري عبد الفتاح السيسي عن فرض حالة الطوارئ لمدة ثلاثة شهور في أعقاب التفجيرات الارهابية المؤثمه التي طالت كنيستي مار جرجس بطنطا والمرقسية بالإسكندرية، ليكون هذا القرار بمثابة أول حالة تطبيق للطوارئ في جميع أنحاء البلاد منذ صدور دستور 2014م .

واذ تؤكد هذه المنظمات علي تجديد رفضها وبالغ ادانتها لهذه الاعمال الارهابية التي تستهدف خرق النسيج الوطني والنيل من وحدة وتماسك هذا البلد ، الا انها تؤكد علي ان فرض حالة الطوارئ لن يكون ابدا حلا لمواجهة الارهاب والتطرف الذي يحتاج الي حزمة من الاجراءات السياسية والمجتمعية عبر مواجهة ثقافية واضحة للفكر الإرهابي ووضع مناهج تعليمية تنمي المواهب و الفنون و الفكر و الإعتدال و الثقافة وتوجيه خطاب ديني مستنير وترك مساحات للابداع والحريات وافساح المجال للمجتمع المدني من اجل ممارسة دوره في ترسيخ قيم المواطنه والتسامح وتعزيز الحقوق والحريات .

أن تجربة فرض حالة الطوارئ التي قد طبقت علي الشعب المصري بمسمياتها المختلفه (حالة الطوارئ /الأحكام العرفية) خلال اكثر من مائة عام لم تثمر الا سلباً للحريات العامة والحقوق الأساسية للمواطنين الأساسية التي كفلها لهم الدستور والمواثيق والمعاهدات الدولية بدعوى العمل على الحفاظ على أمن المجتمع وسلامته من خطر الهجمات الإرهابية ، واعطت الحق للسلطة التنفيذية في انتهاك حقوق المواطنين بعيداً عن رقابة القضاء.

وتطالب المنظمات الموقعه علي البيان رئيس الجمهورية بالغاء هذا القرار والعدول عنه وتطالب مجلس النواب بعدم اقراره والي حين الغاءة تطالب المنظمات الموقعة سلطات الدولة واجهزتها المختلفة بضرورة احترام الدستور وما كفلة من حقوق وحريات اساسية لا يجوز التعدي عليها باي حال من الاحوال ، والالتزام بالمواثيق والمعاهدات الدزلية التي صدقت عليها مصر ومنها العهد الدولي للحقوق المدنية والسياسية الذي حدد مجموعة من الحقوق والحريات التي يجب على الدول العمل على احترامها وصيانتها حتى في ظل حالات الطوارئ، وهي الحق في الحياة والحق في المعاملة الكريمة وعدم جواز إخضاع أي شخص للمعاملة اللاإنسانية أو لأي عقوبة قاسية أو للتعذيب، وكذلك حرية الفكر والوجدان والدين.

وتذكر المنظمات الموقعه علي البيان بالضمانات الحقوقية والدستورية التي وردت في حيثيات حكم الدستورية العليا ،التي وردت في حكمها الصادر بتاريخ 2 يونيو 2013م والتي جاء فيها أنه “لا يجوز أن يتخذ قانون الطوارئ الذي رخص به الدستور ذريعة لإهدار أحكامه ومخالفتها وإطلاقه من عقالها، إذ أن قانون الطوارئ -أيًا كانت مبرراته- يظل على طبيعته كعمل تشريعي يتعين أن يلتزم بأحكام الدستور كافة، وفي مقدمتها صون حقوق المواطنين وحرياتهم.”

Urgent statement

Egyptian Human Rights Organizations: State of emergency is not the solution…

The organizations signing this statement are deeply concerned what the Egyptian President Abdel Fattah Al-Sisi announced of the imposition of the state of emergency for three months in the aftermath of the tragic terrorist bombings that took place in Mary Guirguis church in Tanta and St. Mark’s church in Alexandria. This decision is considered the first application of the state of emergency throughout the country since the promulgation of the 2014 Constitution.

These organizations emphasize on their rejection and condemnation of these acts of terrorism aiming to break the national coherence and undermine the unity and solidarity of this country, except that, they affirm that the imposition of a state of emergency will never be the solution to confront terrorism and extremism, which require a lot of political and societal measures implemented through a cultural confrontation of the terrorist thoughts and the promulgation of educational curricula that develop talents, arts, thought, moderation, culture, an enlightened religious discourse, and allow the creation of spaces for creativity and freedoms, as well as enabling civil society to exercise its role in consolidating the

values of citizenship, tolerance and support of rights and freedoms.

The experience of enforcing the state of emergency that has been applied to the Egyptian people with its various names (the state of emergency / martial law) during more than 100 years has only resulted in the denial of public freedoms and the basic rights of the normal citizen guaranteed by the Constitution and the International Conventions; under the plea of maintaining the security of the community and its safety from the terrorism threat, it also gave the right to the executive

power to violate the rights of the citizens away from judicial control. 

The signing organizations demand from the President of the country to abolish this decision and from the House of Representatives not to approve it, and until its cancellation, they demand from the State Authorities and their different agencies the necessity of respecting what the Constitution stipulated of basic rights and freedoms that cannot be infringed in any way if there isn’t any alternative to imposing the state of emergency and to abide by the international conventions and treaties ratified by Egypt, including the International Covenant on Civil and Political Rights which set a number of rights and freedoms that States must respect and maintain even under emergency situations, namely the right to life, the right to decent treatment and the respect of dignity, no one shall be subjected to torture or to cruel, inhuman or

degrading treatment or punishment, as well as freedom of thought, conscience and religion.

These organizations remind them of the human rights and constitutional guarantees contained in the provisions of the Supreme Constitutional Court, which were stated in its ruling issued on June 2, 2013. It stated that “the emergency law authorized by the Constitution cannot be used as a pretext to waste its provisions, The Emergency Law – whatever its justification – remains as a legislative act that must comply with all the provisions of the Constitution, primarily the safeguarding of the rights and freedoms of citizens.”
